Terms of Service

Welcome to Go Fractional (the "Platform"), operated by Gotta Go Fast, LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Platform, including any content, features, and services provided by us. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Platform.

1. Overview

1.1 The Platform: Go Fractional is a fractional talent marketplace that connects users ("Users" or "you") seeking talent or talent-related services ("Talent") with talented individuals ("Talent Providers") offering their services.

1.2 User Accounts: To access certain features and services on the Platform, you may need to create a user account ("Account"). You are responsible for maintaining the confidentiality of your Account credentials and for any activities or actions taken through your Account. You must promptly notify us of any unauthorized use or security breach of your Account.

2. Content and Intellectual Property

2.1 User Content: The Platform may allow you to submit, post, or display content, such as text, images, videos, and other materials ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, modify, prepare derivative works of, display, and perform your User Content in connection with the Platform's operation and promotion.

2.2 Intellectual Property: All content, features, and functionality available on the Platform, including but not limited to trademarks, logos, service marks, designs, images, videos, text, and graphics ("Platform Content"), are owned or licensed by us and are subject to copyright, trademark, and other intellectual property rights. You agree not to use, reproduce, modify, distribute, or otherwise exploit the Platform Content without our prior written consent.

3. Privacy and Data Collection

3.1 Privacy Policy: Our Privacy Policy governs the collection, use, and disclosure of personal information we obtain from you or that you provide to us. By using the Platform, you consent to the collection and processing of personal information as described in our Privacy Policy.

3.2 Data Collection: We may collect and process certain data and information about you and your use of the Platform. This may include personal information, such as your name, email address, and payment details. We will handle and protect your data in accordance with applicable data protection laws and our Privacy Policy.

4. Talent Services

4.1 Talent Listings: The Platform allows Talent Providers to create profiles and offer their services to Users. While we strive to ensure the accuracy and quality of Talent listings, we do not guarantee the availability, reliability, or suitability of any Talent. Users are solely responsible for evaluating and selecting Talent Providers based on their own judgment.

4.2 Transactions and Payments: Users and Talent Providers may enter into agreements for Talent services through the Platform. We are not a party to such agreements and do not assume any responsibility or liability arising from them. Payments for Talent services may be facilitated through third-party payment processors, and you agree to comply with their terms and conditions.

5. Prohibited Conduct

When using the Platform, you agree not to:

5.1 Violate any applicable laws, regulations, or third-party rights.

5.2 Use the Platform for any unlawful, fraudulent, or malicious purposes.

5.3 Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

5.4 Engage in any activity that could disable, overburden, or impair the Platform's functioning or interfere with other users' enjoyment of the Platform.

5.5 Post, upload, transmit, or share any content that is:

5.5.1 Unlawful or infringes upon the rights of others, including but not limited to intellectual property rights, privacy rights, or publicity rights.

5.5.2 Defamatory, libelous, harassing, threatening, or discriminatory.

5.5.3 Obscene, pornographic, or sexually explicit in nature.

5.5.4 Violent or promotes violence, hatred, or discrimination against individuals or groups based on race, religion, ethnicity, gender, sexual orientation, or any other characteristic.

5.5.5 Misleading, false, or deceptive, including false advertising, spam, or pyramid schemes.

5.5.6 Contains viruses, malware, or any other harmful code that could damage or disrupt the Platform or other users' devices or data.

5.5.7 Invades the privacy of others or discloses personal information without consent.

5.5.8 Promotes or facilitates illegal activities, including but not limited to hacking, unauthorized access to systems, or the distribution of counterfeit or pirated materials.

5.5.9 Violates any contractual or fiduciary obligations, such as disclosing confidential or proprietary information without authorization.

5.6 Monitoring and Moderation:

5.6.1 We reserve the right to monitor, review, and moderate User Content and interactions on the Platform. However, we do not assume any obligation to do so and cannot guarantee the accuracy, completeness, or reliability of User Content.

5.6.2 We may remove or disable access to any User Content that violates these Terms or is otherwise objectionable in our sole discretion.

5.6.3 If you encounter any User Content that you believe violates these Terms or is inappropriate, please report it to us using the reporting mechanisms provided on the Platform.

5.7 Suspension and Termination:

5.7.1 We reserve the right to suspend or terminate your access to the Platform, in whole or in part, if we believe that you have violated these Terms or engaged in any prohibited conduct.

5.7.2 In the event of suspension or termination, you will no longer be able to access your Account or use the Platform, and we may take any necessary legal actions.

5.7.3 We are not liable to you or any third party for any suspension or termination of your access to the Platform.

Please note that this list of prohibited conduct and content is not exhaustive, and we reserve the right to take action against any conduct or content that we deem harmful, inappropriate, or in violation of these Terms, even if not specifically mentioned here.
